Terms of Service

These Terms of Service ("Terms") govern your access to and use of Chimney Pro, the customer relationship management application at chimneypro.app(the "Service"), operated by St. George HVAC & Insulation ("we," "us," or "our"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

Chimney Pro is a business tool for contractors and their teams. Access is by invitation from an administrator or from us, and you must provide accurate information and be at least 18 years old. Your role determines what you can access, and administrators control team access. We may limit, suspend, or remove any account at any time. Customers who receive a document link from us do not need an account to view it.

2. Accounts and security

You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly if you suspect unauthorized access. Permissions depend on your role (such as Admin, Sales, or Crew), and you may only access information needed for your work.

3. Acceptable use

You agree not to:

• use the Service for anything unlawful or outside your authorized duties;
• access, copy, export, or share customer data except as your work requires;
• attempt to bypass security, probe for vulnerabilities, or interfere with the Service;
• upload malicious code or false, defamatory, or infringing content; or
• send messages to customers who have not consented or who have opted out.

4. Customer data and messaging

Customer information entered into the Service is used to run our business as described in our Privacy Policy. Staff who send text messages or emails through the Service must comply with applicable laws, including the Telephone Consumer Protection Act and the CAN-SPAM Act, and must honor opt-out requests (such as a STOP reply).

5. Third-party services and Google Calendar

The Service integrates with third-party services such as Google Calendar, Twilio, Resend, and Supabase. Your use of those services is also subject to their own terms. When an administrator connects a Google account, they confirm they are authorized to do so and may disconnect it at any time. We are not responsible for outages or changes in third-party services.

6. Estimates, pricing, and payments

Estimates, job details, and payment records in the Service are business records. Customers' agreements with us for insulation, HVAC, or maintenance work are governed by the separate estimate or contract we provide, not by these Terms. The Service does not process card payments.

7. Intellectual property

The Service, including its software, design, and content, belongs to us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use it for authorized business purposes while your access is active.

8. Availability and changes

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, including for maintenance and security updates.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, including if you violate these Terms. Sections that by their nature should survive termination will survive.

12. Governing law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Washington County, Utah, and you consent to their jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. The effective date above shows when they were last revised. Continued use of the Service after changes take effect means you accept the updated Terms.
